Terms & Conditions

These Terms and Conditions describe the basis on which Cahaya Systems provides its website, services, and training programmes. Please read them carefully before using our site or engaging our services. If you have questions about anything here, you are welcome to reach us before proceeding.

1. Definitions

In these Terms and Conditions:

  • "Cahaya Systems", "we", "us", "our" refers to Cahaya Systems, a company registered and operating in Malaysia at 27 Jalan Wong Ah Fook, 80000 Johor Bahru, Johor.
  • "Service" refers to any consulting engagement, training programme, audit, or digital resource provided by Cahaya Systems.
  • "User", "you", "your" refers to any individual or organisation that accesses our website or engages our services.
  • "Website" refers to the site located at cahayasystems.world and all associated pages.
  • "Agreement" refers to these Terms and Conditions, together with any separately agreed proposal, quote, or service letter.
  • "Content" refers to all text, materials, training resources, frameworks, slides, and documents produced or shared by Cahaya Systems.

2. Acceptance of Terms

By using our website or engaging our services, you confirm that you have read these Terms, that you understand them, and that you agree to be bound by them. If you are entering into an agreement on behalf of an organisation, you represent that you have the authority to do so.

Our services are intended for business professionals and organisations. Users must be at least 18 years of age. Use by minors is not permitted.

3. Service Description and Availability

Cahaya Systems offers AI integration consulting, employee training programmes, and workflow audit services to businesses operating primarily in Malaysia, with the ability to serve clients nationally and remotely.

We make reasonable efforts to maintain service availability, but we do not warrant uninterrupted access to the website or services. Scheduled maintenance, technical issues, or circumstances beyond our control may affect availability.

Geographic restrictions do not generally apply to our services, though certain programme formats may be designed for in-person delivery in Johor Bahru or Malaysia-based remote participation.

4. User Responsibilities

When using our website or services, you agree to:

  • Provide accurate and truthful information when submitting enquiries or registering for programmes
  • Use our content and materials for your intended business or learning purposes only
  • Treat session facilitators and fellow participants with respect during training events
  • Not reproduce, distribute, or commercially exploit our materials without prior written consent
  • Not use our website to transmit harmful, misleading, or unlawful content
  • Comply with any specific instructions, access requirements, or codes of conduct provided at the time of service delivery

5. Payment Terms

Pricing

All prices are quoted in Malaysian Ringgit (RM) and are exclusive of any applicable taxes unless stated otherwise. Current programme fees are:

  • Natural Language Processing Bootcamp: RM 680 per participant
  • AI-Enhanced Customer Experience Design: RM 2,250 per engagement
  • Intelligent Automation Audit: RM 3,850 per engagement

Prices are subject to change. Any price change will not affect a booking already confirmed in writing.

Payment

Payment terms are specified in the relevant proposal or booking confirmation. For training programmes, full payment or an agreed deposit is typically required prior to programme commencement. For engagement-based services, a milestone-based payment schedule may be agreed in writing.

Refunds and Cancellations

Cancellations made more than 10 business days before a scheduled programme date will receive a full refund. Cancellations within 5–10 business days will receive a 50% refund or the option to transfer the booking to a future date. Cancellations within 5 business days are non-refundable, though we will work with you where reasonable circumstances apply. For engagement-based services, fees for work already delivered are non-refundable.

6. Service-Specific Terms

Training Programmes

  • Participants are expected to attend all scheduled sessions; missed sessions may not be recoverable within the same cohort
  • Programme materials are provided for participant use only and are not for redistribution
  • Completion acknowledgements or participation records are issued at Cahaya Systems' discretion based on attendance and engagement
  • We reserve the right to reschedule a programme with reasonable notice if a minimum participant threshold is not met

Consulting and Audit Engagements

  • Scope of work is defined in the proposal or engagement letter agreed prior to commencement
  • Changes to scope requested after commencement may affect timelines and pricing; any such changes will be agreed in writing
  • Deliverables are provided for the client's internal use and planning purposes; implementation is the client's responsibility
  • We rely on the accuracy of information provided by the client; Cahaya Systems is not liable for outcomes arising from inaccurate inputs

7. Intellectual Property

All content on this website and all materials produced by Cahaya Systems in the course of service delivery — including methodologies, frameworks, templates, slide decks, reports, and written materials — remain the intellectual property of Cahaya Systems unless explicitly transferred in writing.

Clients are granted a limited, non-exclusive licence to use deliverables produced specifically for them, for their internal business purposes. This licence does not extend to sublicensing, resale, or public distribution.

Any content or data you share with us in the course of an engagement remains your property. We will not use it for any purpose outside the agreed scope of work.

8. Disclaimers

Our services are provided in good faith based on the information available and the expertise of our team. We do not make any representation that a specific commercial outcome will follow from any service or training programme. Results depend on a range of factors outside our control, including client implementation, organisational readiness, and market conditions.

The website and its content are provided "as is". While we make efforts to keep information current and accurate, we do not warrant that all content is error-free or complete.

Our services do not constitute legal, financial, regulatory, or medical advice. Where such specialised professional advice is relevant to your situation, we encourage you to seek it independently.

9. Limitation of Liability

To the extent permitted by Malaysian law, Cahaya Systems' total liability arising from or in connection with any service or engagement will not exceed the fees paid by the client for that specific service.

We are not liable for:

  • Indirect, consequential, or incidental losses
  • Loss of profits, revenue, data, or business opportunities
  • Losses arising from reliance on website content without engaging our services directly
  • Disruptions or losses caused by factors outside our reasonable control

10. Confidentiality

Both parties agree to treat as confidential any proprietary or sensitive information shared in the course of an engagement. This includes business data, internal processes, financial information, and strategic plans.

Confidentiality obligations do not apply to information that is publicly available, independently developed, or required to be disclosed by law.

Cahaya Systems will not reference a client's name in marketing materials without prior consent, except for general descriptions of the type of work completed.

11. Termination

Either party may terminate an engagement with written notice if the other party materially breaches these Terms and fails to remedy the breach within 14 days of written notification.

Cahaya Systems may suspend access to its website or services immediately if a user engages in conduct that is abusive, unlawful, or damaging to our operations or reputation.

Upon termination, clauses relating to intellectual property, confidentiality, liability, and dispute resolution survive.

12. Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Malaysia. Any dispute arising from these Terms or from a service engagement will first be addressed through good-faith negotiation.

If a resolution cannot be reached within 30 days of written notice of a dispute, either party may refer the matter to mediation before a mutually agreed mediator in Johor Bahru. If mediation does not resolve the matter, disputes will be subject to the exclusive jurisdiction of the courts of Malaysia.

13. General Provisions

  • Entire Agreement: These Terms, together with any signed proposal or engagement letter, constitute the full agreement between the parties.
  • Severability: If any provision is found unenforceable, the remaining provisions continue in full force.
  • Waiver: Failure to enforce a provision at any time does not constitute a waiver of the right to enforce it in future.
  • Assignment: You may not assign your rights or obligations under these Terms without our prior written consent.
  • Force Majeure: Neither party will be in breach for failures caused by events beyond their reasonable control, including natural events, government actions, or infrastructure outages.

14. Changes to These Terms

We may update these Terms and Conditions from time to time. Updated terms will be posted on this page with a revised "Last Updated" date. For ongoing engagements, material changes will be communicated directly. Continued use of our website or services after an update constitutes your acceptance of the revised Terms.
